Judge Reaffirms Temporary Restraining Order

In response to Viances’ motion seeking to modify the Court’s March 20, 2009 Temporary Restraining Order, the United States District Court for the Northern District of Georgia has reaffirmed its prior ruling prohibiting Viance from making “false and unsupported claims” about Osmose’s “MCQ product and micronized copper preservatives in general.”
The Court stated that Osmose had been “irreparably damaged as a result of [Viance’s] false statements.” For a second time, the Court has prohibited Viance from making conclusions about independent third party studies related to MicroPro and micronized copper. The Court warned that it would “punish with its contempt power any intentional violation” of its order and further cautioned Viance not to “attempt to walk the line in this regard.”
